Ownership of Site; Agreement to Terms of Use
These Terms and Conditions of Use (the “Terms of Use”) apply collectively to the National Testing Network (NTN™) website located at
www.nationaltestingnetwork.com
, Ergometrics™ & Applied Personnel Research Inc. website at
www.ergometrics.org
and any and all sites linked to NTN™ and Ergometrics™, its subsidiaries and affiliates, as 'The site'. The Site is the property of National Testing Network and its licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THIS SITE. NTN™ reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of The Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with the Terms of Use, NTN™ grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use The Site.
Terms and Conditions
Testing and Scheduling Policies
Costs for testing through NTN™ are the User's responsibility. All costs for testing are outlined on The Site's Test Pricing page. As a User, you may add any department jobs as long as you do so before taking the test. After testing, you are only eligible to add new jobs or departments that have opened since the completion of your test. NTN™ emails information regarding new openings as they become available. If you do not choose an open department job prior to taking the test, you may not add the department job after testing until the job is updated as NEW. User test results are good for one year. You are able to choose to retest after three (3) months (some departments require a longer waiting period). If you choose to retest, your previous test scores will be deleted at the time you sign up for retesting and your new score will replace your old score for any agencies that you choose for the new exam once you complete the new exam. If you choose to retest, you will need to select and add any and all department jobs you are interested in, even if any of the jobs were on your previous application. Results will expire and will no longer be available in or from the system after one year. As a User, it is your responsibility to monitor department closing dates and manage testing so that you have valid results at the time of the department closing date(s). NTN™ is not responsible if a candidate misses closing dates or does not have valid scores at the time of closing. The User is responsible to allow enough time for testing. The average video test length is about 2.5 hours. Allow 1.5 hours for PAT testing and at least ½ hour for the CPAT Orientation and ½ hour for CPAT testing. Allow extra time for check-in, instructions, and other possible delays in the testing process. Tests start at the scheduled time. You should arrive 30 minutes before your scheduled exam start time. You will NOT be allowed into the test session if you are late. Late arrivals will be marked as a No Show and testing fees will not be refunded. After a No Show, you may sign up again and schedule a new test; however, you must pay the testing fee and add your departments again. Reschedule requests will be granted up to seven (7) days before your test session at no cost; this option is available in your candidate account. Rescheduling your test within seven (7) days of your test date is not allowed. If you do not take your exam, you must wait until the exam has been missed (No Showed) and then sign up, select and add your departments, and pay the new testing fee.
Test Date Changes
In some cases, exam dates at a testing center may change. If emergencies or other issues require closure of a testing center, you will be notified as soon as possible. We will make every effort to accommodate your schedule and set up your new test at no cost. After you receive notification from the testing center, exams can be rescheduled by clicking the "Contact Support" link on our website and submitting a reschedule support ticket.
Cancellation Policy
Exam fees are not refundable for any reason.
Testing at a Test Center
You must bring your NTN™ Username(s) and Password(s), and photo ID for check-in on your testing day. You will not be permitted to test without a Photo ID. It is recommended to bring a copy of the email confirmation of your test order. You will not be allowed to bring bags, coats, cell phones, electronics of any sort, writing implements, paper, drink bottles or anything else into the test room. NTN™ recommends that such items are left at home or in your secured vehicle. Open shelving may be provided, but security is not guaranteed. Any person who takes prohibited items into the testing room will be considered as having failed the test and will not be admitted at NTN™ Centers in the future. Any candidate found to have a cell phone on their person, whether off or not, will be escorted from the test facility and blocked from future testing. Candidates may not take photos, video or audio recordings, or any other type of imaging in the testing center or testing room. Again, any candidates found in violation will be escorted from the facility and blocked from future testing. Cheating in any form is strictly prohibited. This includes, but is not limited to, note-taking (except where expressly allowed as part of the testing process), removing testing materials from the testing room, bringing in outside notes, looking at other test takers' papers, talking with other test takers during testing, taking any form of electronic recording, or causing any form of disruption during the testing process. Candidates engaging in any suspicious behavior or witnessed to have engaged in any cheating activity will be escorted from the testing facility and blocked from future NTN™ testing. You should arrive 30 minutes before your scheduled exam start time. You will NOT be allowed into the test session if you are late. Late arrivals will be marked as a No Show and testing fees will not be refunded. After a No Show, you may sign up again and schedule a new test; however, you must pay the testing fee and add your departments again.
Virtual Testing
Virtual Testing is done online through use of your laptop or desktop computer. Mobile devices cannot be used for virtual testing. System requirements, instructions, rules, and what to expect are listed on our Virtual Testing Instructions page at

. You should log in 30 minutes before your scheduled exam start time and must be logged in 15 minutes prior to the test start time. You will NOT be allowed into the test session if you are late. Late arrivals will be marked as a No Show and testing fees will not be refunded. After a No Show, you may sign up again and schedule a new test; however, you must pay the testing fee and add your departments again.
Scores
User score results are provided directly to the departments selected by the candidate. With the exception of specifically indicated physical exam letters, you may not print or reproduce your score results for any use. Scores may not be printed or provided to any departments not selected in your testing application process. Printing and submitting test results to departments is not permissible and results provided in this format are not valid. Candidates may not alter scores, PAT, or CPAT results in any way. If you modify or alter scores to provide to a department, your scores will be invalidated in the system and you will be blocked from future NTN™ testing. You have access to NTN™ Candidate Support regarding any questions regarding scheduling, testing, and score transfers. All NTN™ policies and procedures will apply. Final determinations by NTN™ Candidate Support are binding. NTN™, NTN™ Support nor any of its affiliates will discuss test scores with the User. Information regarding test scores, cutoff points or other test information will either be listed in the posting or come from the department directly. It is NTN™ policy not to discuss specific test information with candidates. NTN™ is not a placement firm and does not guarantee any candidate a job or job offer. Participation in NTN™ testing does not guarantee or constitute a job, a job offer, or a passing score. Each individual department determines the pass/fail criteria.
Account Retention
NTN™ contracts with government agencies who are seeking to employ candidates. NTN™ retains all online applications, records, and data in compliance with the US Department of Labor codes of regulation (C.F.R. 60-1.3, 60-1.12) and all other national, state, and local laws and regulations. NTN™ will not delete accounts or data, even on request, and will retain this data for use by the contracted agencies for the purposes of employment, employment records retention, and internal use. We do not sell our data.
Content
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, artwork and computer code (collectively, "Content"), including, but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to NTN™ and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without the express prior written consent from NTN™.
Your Use of the Site
You may not attempt to gain unauthorized access to any portion or feature of The Site, or any other systems or networks connected to The Site or to any NTN™ server, or to any of the services offered on or through The Site, by hacking, password "mining" or any other illegitimate means. You may not probe, scan or test the vulnerability of The Site or any network connected to The Site, nor breach the security or authentication measures on The Site or any network connected to The Site. You may not reverse look-up, trace, or seek to trace any information on any other user of or visitor to The Site. You may not exploit The Site or any service or information made available or offered by or through The Site in any way where the purpose is to reveal any information, including but not limited to personal identification or personal information, other than your own information as provided for by The Site. You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failure to keep this information secure and confidential. You agree to notify NTN™ immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by NTN™ or any other user of or visitor to The Site due to someone else using your NTN™ ID, password or account as a result of your failure to keep your account information secure and confidential. You may not use anyone else's NTN™ ID, password or account at any time. Users may not transfer usernames and passwords to others for any purpose. Any User found to misrepresent identity for their own or other's purposes will be prohibited from testing and all parties involved will be blocked from the Site for future use.

NTN™ DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE AND ITS CONTENT ARE DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. NTN™ CANNOT ENSURE THAT ALL POSTINGS ARE COMPLETELY ACCURATE, ERROR FREE AND/OR UP TO DATE. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE AND/OR ANY NTN™ TESTING SERVICES. Indemnity
You agree to indemnify and hold NTN™, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorney's fees), made against NTN™ by any third party due to or arising out of or in connection with your use of The Site.
Governing Law Dispute Resolution
You agree that all matters relating to access to or use of The Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Washington without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Snohomish County, Washington and waive any objection to such jurisdiction or venue.
